You do have a point. I read that 2 page diatribe and walked away scratching my head. A horse was given a drug that there is no disagreement from anyone that should be banned and ran a couple days later. The horse was caught in a drug test. That is fact and that fact should be paramount in the determination of the sanction.

What I saw was two pages of convoluted reasoning to justify a minimal sanction. Sure a lawyer would probably have eaten the AERC in court based on the fact that it's policy is confusing, not well documented and where it is documented (it's official website) it is wrong. On the other hand the facts still stand - a drugged horse won this ride and tested positive for drugs. The excuses given were as lame as the excuses Rafael Pammanro gave when he tested positive for steroid use by MLB - oh I didn't know I took it. At least MLB had the stones to enforce their drug rule. From what I read in the EN it looks like the AERC was trying like the dickens to figure out how to give a "slap on the hand" for a major violation and walk away.

It seems to me that the AERC better figure out how to write a drug rule that is clear and understandable, contract with labs to test to the rule not to what they think the AERC wants, to put a big set of fangs in it and enforce it.
