Those regulations are the result of the Jockey Club being "a good old boy" organization. They are very content for the whole TB scene to remain unchanged, that is their livelihood, or their recreation. There is good evidence that the TB may have such a small gene pool that meaningful increases in the genetic part of performance are extremely unlikely. The logical response would be to open the registry, and racing, to new genetic material. This will never happen, it would upset to many apple carts.
