Re: [RC] Wilderness areas and RS 2477 - Lif StrandAt 08:45 AM 12/9/2009, Lynn White wrote:Some argue that RS 2477 applies to the shutting off of roads or trails in Wilderness areas. This would mean that if there was a trail or primitive road traversing through public land and was used by the general public before the wilderness act it could not be closed off for public use. I don't know if anyone has challenged this or brought it to the surface. But it could be something in our favor if we wanted to cross a wilderness using an old mining claim road constructed in 1900. Catron County (where I live) has been working on the RS 2477 issue for some time. If anyone is interested, I can send (privately) documents that we have generated on the issue. We've declared hundreds of miles of RS 2477 roads. _____________________________________ Lif C.
