The allegation in any such suit is most likely to be an accusation of some form of negligence or incorrect care.

To penalize a rider for suing a vet, the AERC would first have to separately (from the courts) determine (a) whether the vet was at fault, and (b) if the suit was brought expressly to cause trouble for the vet. Messy.
