Re: [RC] permission to ride on private property - Diane Trefethen

Hi Marlene,

Would a standard Hold Harmless agreement work?

Also, while you are trying to be fair to your neighbors, don't forget to be fair to yourself and your boarders.

Assume you get a good working agreement. The neighbors have a kid who delights in making your horses spook. He routinely hides behind things and pops up suddenly. You tell the neighbors but they do nothing. As your horses begin to get used to this little monster, he decides to up the ante and nails your horse with a slingshot resulting in your hitting the ground to the tune of several broken ribs. Alternate scenario: as above except the kid belongs to some friends who are visiting your neighbors.

You do not want to have signed an agreement that absolves anyone, or their legal guardians, from financial responsibility in the event they deliberately frighten your horses or commit any action that can reasonably be expected to cause a horse to spook.

Accidents happen and you don't want your neighbors on the hook for that. Provocation is not an accident.
