However, I want to add -- that is on the assumption that the rider in question does not encounter gross negligence, or some other situation that is way past acceptable.

IMO - such a waiver says that I'm not going to bring suit because I got DQ'd, or pulled, or overtime, or something didn't go my way. It also says that I will not bring suit when "stuff happens", and everyone did their best in the situation, even if the final outcome was bad. It doesn't absolve them of all responsibility to provide competent care, and a reasonably safe venue.

If you brought suit anyway after having agreed not to, you are in clear
violation of the terms and conditions of entering the ride (i.e. you
broke one of the ride rules). So yes, just bringing suit will give me
cause for denying you entry if for no other reason than that you have
demonstrated yourself to be untrustworthy.
