I believe the term "sore" in the Horse Protection Act refers specifically to Tennessee Walking Horses and other gaited horses with chemical or mechanical injuries deliberately inflicted on their legs and feet --"soring", which is a felony (rarely enforced). However, the language in SB 311 doesn't make that clear, so maybe it could lead to the sort of blanket interpretation that you're worried about.
