Re: [RC] Registration - court order mess... - Kari Hanes

There was court involvement and the worst horses were taken from the premises. The mare we purchased was sold after the fact, the horses that were legally removed were re-registered with minimal paperwork because there was a paper trail from the court system. My understanding is that the owner was told at their hearing to get rid of the rest, so he dumped them at various auctions across the state. Whether or not there was a written order to back that up I have no idea.

I would not think that a "local humane society" could force a person to
disperse their herd without some sort of court involvement. I would work
through the local humane society to find the correct "judge" who issued
the dispersement order and then ask them (the judge) for the correct
paperwork to send to the registry.

I'm hoping someone here can help with this.

First a little background on the situation...We bought a mare at an
auction without papers a few years ago. When we got her home we realized
she was tatooed with her registration number and is a retired arab race
horse. When we started digging into this we found out the previous owner
was ordered to disperse his herd by the humane society in his county due
to animal cruelty, etc. We finally tracked down the owner and he was not
helpful at all. I asked him to name a price for her papers and he flat out
refused for any amount of money. So we turned to the registry for help. We
were told we could get a court order ...

"The court order must be issued by a court of competent
jurisdiction. Examples of orders may be a Declaratory Judgment, Findings
of
Fact and Conclusions of Law, or simply an Order Awarding Title. The order
must clearly state that you have legal title to the horse."

I've been in touch with our county court system and they claim they can't
do any of this without a lawyer filing a court case. Mr. Benedict at the
registry said I should be able to go to my county court house and file for
an order without hiring an attorney. Does anyone have any knowledge of how
this is done? I've been dealing with this for almost two years and am
loosing patience. This is an extremely nice mare, pure Polish, Pepton
daughter. It seems everywhere I turn I get shot down and even more
confused as to what I'm supposed to do next. We would like to breed her
for endurance prospects but don't want to end up with an unregisterable or
half arab foal when we know it's purebred.

Thanks
