As others have said, Pinto is a color registry, a horse of any breed, gaited or not gaited, or any size or shape.
Paint is a breed, a registry of horses with specific bloodlines, specific physical characteristics and a minimum white requirement.
Paints can only be registered as Paints if they are of registered Paint, QH or TB parents AND they must meet the color pattern requirement. With the new rule change, a Paint must now have at least one registered Paint parent.
 
Like with most breeds, their origins have to come from somewhere, and it is true that the registry started first with the QHs that had too much white and were unregisterable, but as the population has grown, there is much more of a push in the Paint world to move towards less and less outside influences from others (hence the one Paint parent requirement).

Paint is a breed the same way that Pinto is a breed ? they have a registry that selects by color.  Paints are Quarter Horses with pinto characteristics and the AQHA will not register them, so they came up with their own registry.
