This is not exactly correct.  There is no "loophole".  It is the same for 50's and 100's.  Tevis, for example, does not give a BC award according to AERC rules, yet it is one of the most prized rules.  In addition, some ride managers have not ignored this rule, they have complied with the rule as written and chosen not to give BC according to AERC rules.
 
I fear that changing the rule will simply cause there to be less LD rides....mb
