I also wondered if the term sore was being used that way.  Acts have definition sections.  The best thing to do would be to push for the term to be unambiguously defined so that's its use within the act is limited to that definition.

I believe the term "sore" in the Horse Protection Act refers specifically to Tennessee Walking Horses and other gaited horses with chemical or mechanical injuries deliberately inflicted on their legs and feet --"soring", which is a felony (rarely enforced). However, the language in SB 311 doesn't make that clear, so maybe it could lead to the sort of blanket interpretation that you're worried about.
