Re: [RC] [RC] [RC] those stinking rich insurance companies pay??? - Truman Prevatt

When government tries to take sides where they have no business taking sides - it can only make things worse. There is over 200 years of history to prove that. Our juries work just fine. If for some reason they do get emotionally carried away in an award, the judge has the option to adjust an award. It works just fine. Tort reform will end up causing more harm than good. I think that should be the lesson learned from the debacle in FL last election.

Most jurors are normal, sensible people who can smell BS a mile away. You grossly underestimate their intelligence and ability to make a rational decision. I would trust my jurors WAY before I would trust a bunch of politicians to decide how much a person should receive for an award.

And yes, the limit is on non-economic damages -- so what? You don't think pain and suffering and permanent disfigurement are legitimate claims? The goal of the tort system is to try to make you whole or compensate you if you cannot be made whole. If you are paralyzed or your face is so severely scarred that it can never be repaired, does $250,000.00 adequately compensate you??? Would you let a person permanently scar you or paralyze you if I offered you $250,000 for it??? There is more to life than your job and other economic factors.

Out of the many, many, many attorneys I know, a grand total of TWO are slime balls and both are domestic law attorneys, not personal injury attorneys.

Well, gotta go. I'm off for court to help a kid with permanent scars from a dog bite from a dog the owners knew was vicious and had bitten before. The insurance company is refusing to pay for plastic surgery and the permanent nerve damage. The other attorney said that they were poor and if they dragged it out long enough the parents would have to settle for a lot less. Ha, ha, ha.
