[RC] Blame the Insurance Companies! - RHONDA LEVINSON<<The Insurance Companies are taken advantage of so often it's not even funny....More often than not if the demand is less than the cost to defend..the Insurance Carrier will settle...even if it's a bogus claim...so if I trip in the super market and skin my knee I could probably walk away with anywhere from $10-$15k just by having an Atty write a letter! Why? Because in order to defend the claim in court the Carrier will probably spend close to $20k. >> This is just so slanted and untrue, I don't even know where to begin. Insurance companies DO NOT SETTLE that easily. In the last two years, I have had ZERO settlements off of letters and TWO settlements off of settlement brochures. I have had to litigate all of the other cases -- and I did not lose any of them, by the way, so they were not bogus claims. If you trip and skin your knee, the insurance company will snort and tell you to get lost. Slip and fall cases are notoriously difficult to win and in a supermarket, you have to prove that the market knew or should have known that whatever you slipped on was there -- very difficult to do.
