Re: [RC] It's called "Battery" Angry in the mountains of Idaho! - Dabney Finch

I think you mean "assault."  "Battery" is the physical assault often accompanying the threats.

The verbal assaults are called "Battery" and that is against the law, it is usually used with a actual physical assault.

If I were you I would talk to my lawyer.  The sheriff may not understand as much about law as he thinks.  At the minimum the person was intimidating you.  I also suspect that if push came to shove a jury would conclude that the threat that your horse would not come out implied that you would also not come out.  It would be very hard to kill or stop a horse without putting you in danger.  Again, it is not legal to endanger a person, even if your didn't intend to.  A reasonable person would know that.

Doesn't the part now in red mean a threat to the person here?  The person has to be on that horse to get there, and you riding on it.  To me this would mean that YOU wouldn't be coming out of there as the  horse wouldn't be...interpretation, but if I were on the jury here you'd be in good shape!
