That's because you don't live in CA.  CA is the most restrictive state I've ever heard of regarding anything that just "might" harm someone.  The state laws are refined to a fine point of protecting all of us from ourselves, allowing no one to take any risks, make any judgment for themselves, or bear responsibility for themselves.  It must have something to do with litigation.  You use creosote, you burn your hands, you sue someone for injury, mental stress, lost work time, et al.  You use an ant poison that will actually kill ants and prevent them from flooding your kitchen, and your child eats it, you sue.  The world has gone mad.....

That's interesting, I didn't know that. You can still use it in Oklahoma apparently. There is a mill about 5 miles from mom's house that coats fence posts in the stuff. I see them hauling semi loads out of there all the time.

Creosote is a great deterrent to fence chewing.  It is also banned in California as a carcinogenic substance.  So much of the good stuff, the things that really work, are banned in CA.  You can't even buy an ant poison here that will work.
