[RC] waiver - Sharlene Roberts-Caudle

States differ in effective waiver language.  You might
want to check out waiver agreements for risky sports
in your state.  Also, a parent cannot waive a minor's
legal rights.  In California waivers typically include
indemnification language, the form is sometimes called
"Waiver and Indemnification Agreement."

The document should have waiver language with words to
constitute informed assumption of risk, and language
requiring the waiving party to defend and indemnify
the other party in case of any claim made on their, or
their child's behalf.  Thus, if a guardian ad litem
for the child brings a suit, that parent is required
to defend you and pay any damages.

If it were me, I would also include contract language
that shows what the benefit is to the waiving party,
for example:  "In consideration for executing this
Waiver and Indemnification agreement, I understand
that I/we will be permitted to engage in (blah blah
blah)activities at (name)
