This, at least, is a specious argument.
Insurance should pay for the treatment, whether you got hurt with or without the helmet.
Insurance rates are set from a whole lot of parameters.
If riding, as was pointed out, is the second most dangerous sport, it could be banned altogether one day, don't you think?. What will you say then?
