This is my thinking as well, and that of the AERC to date. However,
that could change, and the AERC would be well within its rights to
require wearing helmets for *all* competitors. The justification being
the potential legal/liability exposure.

Just try to drive in a NASCAR race, or any organized automobile race,
without wearing the *required* safety equipment. Not just seat belts
and helmets, but nomex (fire-resistant) suits, in cars equipped with
mandatory roll cages.

If a sport's sanctioning body determines that some piece of safety gear
is essential for some minimum degree of safety, they can have rules
making the use of such equipment mandatory. It is not a rights issue.
By signing the entry form and paying your fee you agree to abide by the
rules of the event; no one is forcing you to ride.

Remember, my own personal opinion is that we should *not* have a
mandatory helmet rule for adults in endurance (even though I will never
compete without one myself) -- but if the Board should decide otherwise,
it has the right to do so.
