    Strange the way things go.
    I of course over the years have always thought AERC should  SHOULD
    have a helmet  rule and  JR age rule.  BOTH will never happen for
    years  but eventually  based on insurance  requirements we will be
    forced to change.
    
    Now all that aside.  MY personal wreck back in Jan - at an AERC ride on
    private land a BSA Camp run by a private RM.
    
    This little crash has cost BC-Bs about 50K so far - I have spent my
    $2500 limit for the year - last week I hit that limit, SO NOW BCBS has to PAY
    MORE.
    I got the CALL, from BCBS LEGAL AND CLAIMS FRAUD office last week.
    
    They wanted know what happened. I gave very little details.
    They wanted to know  more  they KNEW it was a fall from the horse
    1. Was it MY horse
    2. Did I have a helmet on??
    3. Was this a COMPETITIVE EVENT.
    4. Was I going fast.
    5. Was it on PRIVATE property.
    6. WHO organized the event.
    7. WHO caused the fall.
    
    and some things I failed to hear by now ...
    
    AND THE BIGGIE.
    
    WHO   yes  WHO  WAS I SUING... NOT IF -- but WHO.
    
    I hit the HOT button.
    
    After 25 years of paying them their exhorted  high fees, they can pay
    for this wreck.
    
    I told them in my own way - think about that one.. I was responsible
    for my own actions -  IT WAS JUST A DA... ACCIDENT - MY horse FELL in a
     d... hole NO ONE CAUSED IT.
    
    I was on a dirt road in GA out in the woods. I have no idea where or
    WHO owned the land - IT WAS NO ONES FAULT..
    I was a bit tense and in their face.. I asked them just what they
    wanted to do about this.??
    I was suing NO ONE.
    
    THE person  jerk - told me they wanted to recoup some of their losses..
    CRIPS  The INSURANCE is suppose to accept a few losses. BUT NO they
    wanted to SUE someone -  anyone.
    
    NOW it does appear since I am not suing and will not tell them much
    they have no recourse expect to either take legal action to tell them
    more or let it go.
    
    IN THE EVENT I WAS suing someone they would be there IN-FRONT of me to
    get their money first.
    
    A real mess and it may not be over  since I am going to physical therapy
    3 times per week. They have more money to pay out.
    
    This just points out out what low lifes there are in the insurance
    business. They dont want to cover you but have to then dont want to pay
     but have to pay some then they want YOU to go get what they paid out
    back from someone with deep pockets.
    
    Does anyone think that IF they wanted to file a suit that some 2 lined
    legal statement is going to stop them from placing a suit against the
    Ride manger and the Boy Scout camp and you can bet AERC.
    
    Does not matter IF  the suit is valid or even contestable in court.
    The bottom line they will file - then the insurance company for the RM
    will pay BCBS and the Boy Scout camp Insurance will pay more and then
    the AERC insurance may get to pay more.. so the bottom line here is 3
    other insurance companies could be made to pay the cost of my fall.
    BCBS will try to obtain ALL their losses. The other insurance
    companies will pay rather then fight it out in court, and you all know
    that.
    
    DIRT BAGS.
    I will refuse to give them ANY more information - until they threaten
    to take me to court OR stop paying my costs of repair. THAT is why I
    have the dammm insurance in the first place.
    In less you all who are
    fully responsible for ones' own action think I should pay for all this
    myself?
    
    Ask your self one thing.. would YOU shell out 50K to cover the costs
    of you falling off your horse - do you have that much self insurance
    funds , since you are taking responsibility for your own actions -0 you
    really should NOT ask the insurance company to pay for it ???
    
    This could get messy.
    Next call from these jerks I guess I will get a lawyer.
    
    few other point to ponder - suppose I was not wearing a helmet and
    living on a box?  or suppose  I was 5 years old ... SOMEONE WOULD surely be suing
    someone.  bet on it.
