Baseball requires the hitter to wear a helmet.
Baseball, football, car racing are professional sports. They can require
anything they want. The organizations that put on the events aren't
non-profits and in the first two, the participants are employees, in the
last they're getting money prizes and all that stuff. It makes a big
difference! We're an amateur sport with non-professionals participating. I
think what AERC can or should demand is different from pro sports.
When we send our kids out to ride bikes or skateboards do we protect them
to the best of our ability? I know I did
Yup - the parent, the legally responsible entity, protects the kid. The
question to me is: Is AERC the legally responsible entity? I think the
waivers say it all. No, the *participants* are the legally responsible
entity.
AERC can suggest protective gear, but I think the moment AERC considers
*requiring* it is the day the lawsuits will really start.
