The money collected for drug testing is in a fund earmarked for that purpose
in the AERC accounts. Due to legal and technical questions that have arisen
(especially regarding a protest and penalty concerning a drug positive
result) it has been deemed appropriate not to conduct further testing until
these legal and technical questions can be resolved. At the AERC midyear
board meeting a sub-committee was formed with members from the veterinary,
legal, rules, office, and protest and grievance committees to study the
entire drug program, this study to be completed and a recommendation made to
the Board within 90 days. As soon as a "foolproof" system for conducting and
evaluating drug testing can be put in place, drug testing will resume. (Of
course drug testing will continue in California, where it is a state law)
